This Database of the Connemara Pony Breeders Society (“the Database”) is provided by Connemara Pony Breeders Society (“CPBS”) whose business address and registered office is at The Showgrounds, Clifden, Co. Galway (Company Registration Number: 17849; Country of Registration: Ireland). CPBS is registered in Ireland. It is a company limited by guarantee and not having a share capital. These Terms and Conditions of Use of Database and our Privacy Policy govern the use of the Database. By accessing this Database, you agree to be bound by these Terms and Conditions of Use of Database. CPBS reserves the right to amend or modify these Terms and Conditions of Use of Database without notice, at its sole discretion by posting any altered Terms and Conditions of Use of Database on the site. If you do not agree with the Terms and Conditions of Use of Database, you must not access the Database.

Acceptable Use

You are responsible for your use of the Database. You may only use the Database for lawful purposes. You may not engage in any conduct that:

breaches CPBS' intellectual property rights including but not limited to patents, copyright, database rights, design rights, trade marks (registrable or not), trade secrets or know-how;
is deceptive, offensive, threatening, abusive, harassing, defamatory, libellous or fraudulent;
impersonates any person, company or entity including CPBS, its employees, agents and affiliates;
introduces viruses or any other code, files or programs which interrupt, destroy or limit the functionality of any computer software, hardware or equipment belonging to CPBS;
constitutes a criminal offence or that gives rise to civil liability as well as encourages such conduct;
violates these Terms and Conditions of Use of Database or the Privacy Policy; or
interferes with the use and enjoyment of the Database by others.

You will not (and will not assist or facilitate any third party to) copy, download, reproduce, publish, modify, transfer, display, distribute, perform, license, disseminate or broadcast in any way whatsoever any information, content, program, design, screen icon, GUI or materials on or relating to the Database. CPBS reserves the right to edit, modify, alter, remove or shut down or alter all or any part of the Database (including information, content or material on the Database) without notice.

You will be asked for your name and email address upon registration for access to the Database. By registering for this Database, you agree to comply with and be bound by these Terms and Conditions of Use of Database.

You will obtain a password for your account. Please keep this password safe and secure. You will be liable for any activity on your account. If you believe someone has accessed your account illegally or without your consent, please notify CPBS immediately.

Your membership is valid for a single CPU, regardless of whether the registration is on behalf of a third party.

If you breach any of these Terms and Conditions of Use of the Database or our Privacy Policy, or otherwise engage in behaviour which is deemed by CPBS to be inappropriate, your registration may be suspended or terminated at the sole discretion of CPBS. You will not be able to access the Database during a period of suspension or if your registration is terminated.

License & Grant of Rights

CPBS grants you a revocable, non-exclusive, non-transferable licence to access and use the Database subject to these Terms and Conditions of Use of Database.

You may not grant a sub-licence of this right without the prior written permission of CPBS.

The Database is protected by copyright and other intellectual property rights. You may not reproduce all or any parts of the Database. The Database may only be used for your personal and private use and not for any commercial purposes.

You shall not reproduce, transmit, broadcast or display in public all or any parts of the Database without the prior written permission of CPBS.

You acknowledge that you will not acquire any intellectual property rights or other proprietary rights in the Database other than as provided for in these Terms and Conditions of Use of Database.

Limitation of Liability

You understand and agree that the Database is provided on an “as is” basis. The Database is available without any representations or warranties of any kind, either express or implied. To the maximum extent possible by law, CPBS disclaims all warranties in relation to the information, content or materials on the Database. CPBS makes no representations, warranties or undertakings in respect of the Database or any of the information, content or material on the Database or its quality, accuracy or fitness for purpose or any of the information, content or material on any website referred to or accessed by hypertext link or otherwise through the Database. CPBS also does not represent or warrant that the Database shall be free from inaccuracies or typographical errors. CPBS expressly excludes any warranty, representation or undertaking that you will be able to access or use the Database at times or locations of your choosing. CPBS does not represent or warrant that the Database will be free from any virus, worm, Trojan horse or that the Database will be uninterrupted, secure or error free or is compatible with any other software or material.

CPBS shall not be liable for any loss or damages (including but not limited to consequential, special, direct, indirect or damages) nor for any loss of data, profit, revenue or business, whosoever caused, arising from the use of (or inability to use) the Database; from any inaccurate or misleading information, content or material contained on the Database and any reliance on same is at your own risk.

The limitation of liability in these Terms and Conditions of Use of Database does not exempt fraud and misrepresentation, death or personal injury caused by CPBS' negligence.

Indemnity

You agree to defend and indemnify CPBS including its officers, directors and employees, servants and agents, against all liability, claims and expenses including legal fees arising out of any breach of these Terms and Conditions of Use of Database by you and if applicable, your officers, directors and employees, servants and agents and against any liability arising out of your use of the Database.

Privacy

You may be asked to input information about yourself to access the Database. CPBS will not use the information you provide for any purpose other than that stated at each location where such information is requested. Such use of the information will be governed by our Privacy Policy.

Termination

Other than as provided for elsewhere in these Terms and Conditions for Use of Database, CPBS reserves the right to immediately terminate your use of the Database in circumstances including but not limited to where you or if applicable your officers, directors and employees, servants and agents breach or procure a breach of these Terms and Conditions of Use of Database or otherwise engage in conduct which CPBS determines in its sole discretion to be unacceptable or harmful to it or its users.

Waiver

The failure of CPBS at any time to enforce any provisions of these Terms and Conditions of Use of Database shall in no way affect its right thereafter to do so. Any waiver by CPBS of any breach of any term, provision or condition shall not be taken or held to be a waiver of any subsequent breach of any such term, provision or condition or to be a waiver of the term, provision or condition itself.

Agency

Nothing herein shall be deemed to create any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between CPBS and any user, third party or other person or entity.

Governing Law

These Terms and Conditions of Use of Database shall be governed and construed under the laws of Ireland. The parties agree to submit to the exclusive jurisdiction of the courts of Ireland to settle any disputes which may arise from or in connection with these Terms and Conditions of Use of Database.

Severability

If any court of competent jurisdiction decides that any part, term or provision of these Terms and Conditions of Use of Database is invalid or otherwise unenforceable, such provision shall be severed and deleted from these Terms and Conditions of Use of Database and the remainder of these Terms and Conditions of Use of Database shall continue to have force and effect.

Terms & Conditions of Services Provided

Foal and Pony Registrations

1. Account Security

Your login details are private—never share them or send them by email or text.
The CPBS will never request your login information by email, text, or phone.
All activity completed via cpbsonline is deemed to be performed by the account holder.
If you notice suspicious activity, contact the CPBS office immediately.

2. Equine Premises Number

A valid equine premises number is required to register a pony.
The premises number must reflect where the animal normally resides.
If the number belongs to someone else, they will be recorded as the agent/keeper.
Incorrect or missing premises numbers will result in your application being returned.

3. Registration Requirements

If the pony already has a passport/microchip from another PIO, registration must be completed via ItsPlainSailing or paper application.
Sire and dam must be registered with the CPBS before a foal/pony can be registered.
If unsure of the sire, you may list up to 2 additional sires free of charge.
If sire or dam samples are unavailable, microsatellite testing will be required at an additional cost.

4. Naming Rules

Pony names may use a maximum of 30 characters (including spaces).
Registered prefixes cannot be used without written permission from the prefix owner.
Once a pony is named it is named for life and cannot be changed.
Derogatory terms used in the naming will be refused and will cause delays.

5. DNA, HWSD & Parentage Verification

Additional fees apply if samples result in exclusions or require repeat testing.
A Lifetime Document is issued only after parentage and HWSD status are verified by Weatherbys Scientific (processing may take up to 10 weeks).
If exempt from HWSD testing but an exclusion occurs, HWSD testing must be completed before the passport is issued.
All HWSD & SNP status information is viewable on www.cpbsonline.ie.

6. Issuing of Passports

The passport is issued to the registered owner (the person who applies for the DNA kit).
Transfer of ownership or changes to the marking chart/name/address will not be accepted at this stage.

7. Membership & Fees

Membership rates apply only to current, paid members (membership is not transferable).
Foal registration rate applies until 31 August; higher fees apply thereafter.
Foal samples received after 15 September incur additional fees and will not be sent to the lab until all fees are paid.

Declaration

By submitting this form, I confirm that I have read this form and all related documents carefully. I am aware of and understand the rules and guidelines governing the registration of my foal/pony.

I declare that all information provided in this application is accurate. I accept that I am responsible for any additional fees that may arise due to errors or omissions in my submission.

I understand that the DNA data collected will be shared with the National Breeding Services Programme for research purposes.

Disclaimer

Cumann Lucht Capaillíní Chonamara (CPBS) is committed to maintaining the integrity of the studbook and preventing the entry of non–purebred equines through DNA testing and progeny verification.

The CPBS cannot be held responsible for any actions occurring outside its remit. Any sample(s) submitted as part of this process will be treated as the correct sample for the animal. Arbitrary testing may be carried out to ensure accuracy and compliance.

By submitting this form, I agree to indemnify Cumann Lucht Capaillíní Chonamara (CPBS) against any claims or actions arising from the intentional or unintentional misidentification of an equine within this scheme. Responsibility for any such misidentification lies solely with the individual submitting the form.

Inspections & Classifications

I confirm that I have read and understand the terms and conditions outlined in the procedures and conditions documents available on the https://cpbs.ie/cpbs-breeding-programme.

By submitting this application, I agree to have my pony, as described on this form, inspected by persons appointed by the Council of the Connemara Pony Breeders’ Society (CPBS) for classification in the CPBS Studbook. I agree to comply with the Procedures and Conditions for Inspection and Classification of Connemara Ponies, available at https://cpbs.ie/cpbs-breeding-programme.

I confirm that the details provided by me are accurate and accept responsibility for any additional fees arising from errors in my application. If my animal has not been tested for HWSD, a sample will be taken on the day of inspection. I understand that my passport will not be updated until the results of the HWSD test are returned. Additionally, if my animal is not yet transferred to a genotype profile a second sample will be secured on the day. I understand that DNA data will be shared with the National Breeding Services Programme for research purposes.

I accept the Inspectors’ decision as final and binding. I also acknowledge that the CPBS processes personal data in line with the GDPR Act 2018 and that I have read and understood the GDPR Notice and Privacy Policy available at www.cpbs.ie.

Transfer of Ownership

By submitting this form, I confirm that all details provided regarding the transfer of ownership of the pony identified on this form are accurate and that I am the new legal owner of the pony. I confirm that I comply with the statutory requirements of DAFM S.I. No. 113/2014 relating to the Control on Places where Horses are Kept and that I have read and complied with the legal obligations concerning Transfer of Ownership as outlined below.

In addition, I acknowledge that the CPBS processes personal data in accordance with the General Data Protection Regulation (GDPR) Act 2018, and I confirm that I have read and understand the CPBS GDPR Notice and Privacy Policy as published on www.cpbs.ie.

Membership

I agree to abide by the rules and regulations and the Memorandum and Articles of the Connemara Pony Breeders Society, and to work for the attainment of its objectives, which I will fully support.
