This Database of the Connemara Pony Breeders Society (“the Database”) is provided by Connemara Pony Breeders Society (“CPBS”) whose business address and registered office is at The Showgrounds, Clifden, Co. Galway (Company Registration Number: 17849; Country of Registration: Ireland). CPBS is registered in Ireland. It is a company limited by guarantee and not having a share capital. These Terms and Conditions of Use of Database and our Privacy Policy govern the use of the Database. By accessing this Database, you agree to be bound by these Terms and Conditions of Use of Database. CPBS reserves the right to amend or modify these Terms and Conditions of Use of Database without notice, at its sole discretion by posting any altered Terms and Conditions of Use of Database on the site. Your membership is valid for a single CPU, regardless of whether the registration is on behalf of a third party.
If you breach any of these Terms and Conditions of Use of the Database or our Privacy Policy, or otherwise engage in behaviour which is deemed by CPBS to be inappropriate, your registration may be suspended or terminated at the sole discretion of CPBS. You will not be able to access the Database during a period of suspension or if your registration is terminated.
CPBS grants you a revocable, non-exclusive, non-transferable licence to access and use the Database subject to these Terms and Conditions of Use of Database.
You may not grant a sub-licence of this right without the prior written permission of CPBS.
The Database is protected by copyright and other intellectual property rights. You may not reproduce all or any parts of the Database. The Database may only be used for your personal and private use and not for any commercial purposes.
You shall not reproduce, transmit, broadcast or display in public all or any parts of the Database without the prior written permission of CPBS.
You acknowledge that you will not acquire any intellectual property rights or other proprietary rights in the Database other than as provided for in these Terms and Conditions of Use of Database.
You understand and agree that the Database is provided on an “as is” basis. The Database is available without any representations or warranties of any kind, either express or implied. To the maximum extent possible by law, CPBS disclaims all warranties in relation to the information, content or materials on the Database. CPBS makes no representations, warranties or undertakings in respect of the Database or any of the information, content or material on the Database or its quality, accuracy or fitness for purpose or any of the information, content or material on any website referred to or accessed by hypertext link or otherwise through the Database. CPBS also does not represent or warrant that the Database shall be free from inaccuracies or typographical errors. CPBS expressly excludes any warranty, representation or undertaking that you will be able to access or use the Database at times or locations of your choosing. CPBS does not represent or warrant that the Database will be free from any virus, worm, Trojan horse or that the Database will be uninterrupted, secure or error free or is compatible with any other software or material.
CPBS shall not be liable for any loss or damages (including but not limited to consequential, special, direct, indirect or damages) nor for any loss of data, profit, revenue or business, whosoever caused, arising from the use of (or inability to use) the Database; from any inaccurate or misleading information, content or material contained on the Database and any reliance on same is at your own risk.
The limitation of liability in these Terms and Conditions of Use of Database does not exempt fraud and misrepresentation, death or personal injury caused by CPBS' negligence.
You agree to defend and indemnify CPBS including its officers, directors and employees, servants and agents, against all liability, claims and expenses including legal fees arising out of any breach of these Terms and Conditions of Use of Database by you and if applicable, your officers, directors and employees, servants and agents and against any liability arising out of your use of the Database.
You may be asked to input information about yourself to access the Database. CPBS will not use the information you provide for any purpose other than that stated at each location where such information is requested. Such use of the information will be governed by our Privacy Policy.
Other than as provided for elsewhere in these Terms and Conditions for Use of Database, CPBS reserves the right to immediately terminate your use of the Database in circumstances including but not limited to where you or if applicable your officers, directors and employees, servants and agents breach or procure a breach of these Terms and Conditions of Use of Database or otherwise engage in conduct which CPBS determines in its sole discretion to be unacceptable or harmful to it or its users.
The failure of CPBS at any time to enforce any provisions of these Terms and Conditions of Use of Database shall in no way affect its right thereafter to do so. Any waiver by CPBS of any breach of any term, provision or condition shall not be taken or held to be a waiver of any subsequent breach of any such term, provision or condition or to be a waiver of the term, provision or condition itself.
Nothing herein shall be deemed to create any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between CPBS and any user, third party or other person or entity.
These Terms and Conditions of Use of Database shall be governed and construed under the laws of Ireland. The parties agree to submit to the exclusive jurisdiction of the courts of Ireland to settle any disputes which may arise from or in connection with these Terms and Conditions of Use of Database.
If any court of competent jurisdiction decides that any part, term or provision of these Terms and Conditions of Use of Database is invalid or otherwise unenforceable, such provision shall be severed and deleted from these Terms and Conditions of Use of Database and the remainder of these Terms and Conditions of Use of Database shall continue to have force and effect.

The CPBS cannot be held responsible for any actions occurring outside its remit. Any sample(s) submitted as part of this process will be treated as the correct sample for the animal. Arbitrary testing may be carried out to ensure accuracy and compliance.

I confirm that the details provided by me are accurate and accept responsibility for any additional fees arising from errors in my application. If my animal has not been tested for HWSD, a sample will be taken on the day of inspection. I understand that my passport will not be updated until the results of the HWSD test are returned. Additionally, if my animal is not yet transferred to a genotype profile a second sample will be secured on the day. I understand that DNA data will be shared with the National Breeding Services Programme for research purposes.
